Acceptance
of Terms
AnchorFree,
Inc. and its subsidiaries and affiliates ("AnchorFree") provide this website
(the "Site") and any services available on the Site (each, a "Service") to you
subject to the following terms and conditions ("Terms"). These Terms constitute
a binding legal agreement between you and AnchorFree regarding your access and
use of the Site and any Service. Please read this Agreement carefully. By
accessing or using the Site or a Service, you accept these Terms and any

resources, including tools, download areas, premium content, communication
forums and product information (collectively, "Services"). You understand and
agree that the Services may include advertisements and that these
advertisements are necessary for AnchorFree to provide the Services. The
Services, including any updates, enhancements, or new features, are subject to
these Terms.

Any
software that is made available to download from this Site ("Software") is the
copyrighted work of AnchorFree and/or its suppliers. Use of the Software is
governed by the terms of the End User License Agreement, if any, that
accompanies or is included with the Software ("EULA" or "License Agreement").
You will be unable to install any Software that is accompanied by or includes a
EULA unless you first agree to the License Agreement terms. Any reproduction or
redistribution of the Software that is not in accordance with the EULA is
expressly prohibited by law and may result in severe civil and/or criminal
penalties. Violators will be prosecuted to the maximum extent possible.
WITHOUT
LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER
SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY
PROHIBITED, UNLESS SUCH REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PERMITTED
BY THE LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE. THE SOFTWARE IS WARRANTED,
IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT. EXCEPT AS
WARRANTED IN THE LICENSE AGREEMENT, ANCHORFREE HEREBY DISCLAIMS ALL WARRANTIES
AND CONDITIONS WITH REGARD TO THE SOFTWARE, INCLUDING ALL WARRANTIES AND
CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, OF MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
As
further set forth in the EULA: (a) the United States export control laws
prohibit the export of certain technical data and software to certain countries
and territories. No Software from this Site may be downloaded or otherwise
exported in violation of United States law; and (b) any Software that is
downloaded from this Site for or on behalf of the United States of America, its
agencies and/or instrumentalities ("U.S. Government"), is provided with
restricted rights. Use, duplication, or disclosure by the U.S. Government is
subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights
in Technical Data and Computer Software clause at DFARS 252.227-7013 or
subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted

Confidentiality
This
Section 5 applies to users of a Site where the user may register for an
account. You acknowledge that portions of this Site may contain valuable
Confidential Information (as defined below) of AnchorFree, and you agree to

use, copying, distribution or disclosure. Without limitation of the foregoing,
you agree to use the Confidential Information solely for the purposes for which

information of a third party that AnchorFree is obligated to keep confidential,
including, but not limited to, information that relates to AnchorFree's
products, services, technology, research, development, product ideas, clients,
customers, employees, contractors, business and marketing plans, finances,
contracts, legal affairs, business affairs or any other confidential or
proprietary matter, subject or issue.

Account, Password and Security
This
Section 6 applies to users of a Site where the user may register for an
account. For certain of the Services, you will receive a password and account
designation. You are responsible for maintaining the confidentiality of the
password and account, and are fully responsible for all activities that occur
under your password or account. You agree to (a) immediately notify
AnchorFree of any unauthorized use of your password or account or any other
breach of security, and (b) ensure that you exit from your account at the end
of each session. AnchorFree cannot and will not be liable for any loss or
damage arising from your failure to comply with this section or relating to

trademarks of AnchorFree and its licensors, and may not be copied, imitated or

service marks, trademarks, and/or trade dress of AnchorFree, and may not be
copied, imitated, or used, in whole or in part, without the prior written
permission of AnchorFree. All other trademarks, registered trademarks, product
names and company names or logos mentioned herein are used for identification
purposes only, and are the property of their respective owners.

. Repeat Infringer Policy; Claims of Copyright Infringement; Designated Agent
AnchorFree
respects the intellectual property of others, and we ask our users to do the
same. AnchorFree may, in appropriate circumstances and in its sole discretion,
limit access to this Site and/or terminate the accounts of any users who
infringe the intellectual property rights of others. If you believe that your
work has been copied in a way that constitutes copyright infringement, or that
your intellectual property rights have been otherwise violated, please provide
AnchorFree's designated copyright agent the following information: (a) an
electronic or physical signature of the person authorized to act on behalf of
the owner of the copyright or other intellectual property interest; (b) a

Indemnification

and agents, from and against any third party claims, damages, loss, liability,
costs and expenses (including, but not limited to, reasonable attorneys' fees)
arising out of your use of the Site and any discussion forums or interactive
areas contained herein, including without limitation any actual or threatened
suit, demand, or claim made against AnchorFree and/or its independent
contractors, service providers, or consultants, arising out of or relating to
your conduct, your violation of these terms and conditions, or your violation
of the rights of any third party.

Applicable Law and Venue; Statute of Limitations
Any
claim or cause of action arising out of or related to use of the Site, the
Services or the Terms will be settled by binding arbitration in accordance with
the commercial arbitration rules of the American Arbitration Association. Any
such controversy or claim must be arbitrated on an individual basis, and must
not be consolidated in any arbitration with any claim or controversy of any
other party. The arbitration must be conducted in Seattle, Washington USA, and
judgment on the arbitration award may be entered into any court having
jurisdiction thereof. Either you or AnchorFree may seek any interim or
preliminary relief from only the state or federal courts located in King
County, Washington, as necessary to protect the rights or property of you or
AnchorFree, and you hereby irrevocably and unconditionally consent and submit
to the exclusive jurisdiction of such courts in such instances. You agree that
regardless of any statute or law to the contrary, any claim or cause of action
arising out of or related to use of the Site, the Services or the Terms must be
made within one (1) year after such claim or cause of action arose or be
forever barred.
18.
Modification & Amendments
AnchorFree
reserves the right to amend at any time any policies governing this Site,
including these Terms, by posting the amended terms and providing notice of
such amendments. The amended terms shall be effective immediately after they
are initially posted on this Site. If you do not agree with any amended term,
you must cease using this Site and all Services.
19.
Termination
Notwithstanding
any of these Terms, AnchorFree reserves the right, without notice and in its
sole discretion, to terminate your license to use this Site, and to block or
prevent future access to and use of this Site. These Terms may not be otherwise
amended except in a written document signed by AnchorFree.
20.
Waiver; Severability; No Third Party Beneficiaries
No
waiver by AnchorFree, whether express or implied, of any provision of these
Terms shall constitute a continuing waiver of such provision or a waiver of any
other provision of these Terms; nor shall AnchorFree be estopped from enforcing
any provision of these Terms, except by written instrument executed by
